CITY SCENT — TERMS AND CONDITIONS

Welcome to City Scent. These Terms and Conditions (“Terms”) govern your use of the City Scent mobile application (the “App”) and the services offered through it, operated by City Scent (“City Scent”, “we”, “us”, or “our”), a fragrance products company operating in Iraq and the region, with its website at https://www.cityscent.co. By downloading, installing, registering with, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the App.
1. ABOUT CITY SCENT
City Scent designs, manufactures, and distributes fragrance products, including fragrance oils, fabric scents, aerosols, and scent diffusion machines for residential and commercial use. We operate branches across Iraq and provide related services such as free trials, maintenance visits, and product warranty coverage.
2. ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account and place orders. To use certain features, such as placing orders, viewing invoices, or contacting support, you must register an account by providing accurate information including your name, phone number, and city. You are responsible for maintaining account confidentiality and all activity under it. Notify us immediately if you suspect unauthorized use. We may suspend or terminate accounts that provide false information, abuse the App, or violate these Terms.
3. PRODUCTS, PRICING, AND AVAILABILITY
Product descriptions, images, and prices are displayed for your convenience. We make reasonable efforts to keep them accurate and up to date, but errors may occur, and colors or appearance may differ slightly from images shown. Prices are shown in the currency indicated in the App and may change without prior notice; the price applicable to an order is the price displayed when you place it. Availability may vary by branch and city, and we may limit quantities, discontinue products, or refuse orders at our reasonable discretion.
4. ORDERS, CHECKOUT, AND DELIVERY
When you place an order, you make an offer to purchase selected products. An order is confirmed only when we accept it through the App, by notification, or by phone. You agree to provide accurate delivery information. We are not responsible for failed or delayed deliveries caused by incorrect or incomplete information you provide. Delivery times are estimates and may vary depending on location, branch availability, and other circumstances. Payment is made using available methods in the App or on delivery, and an invoice will be available in the App. If we cannot fulfill an order, we will contact you and refund any affected amount that was already paid.
5. FREE TRIALS, MAINTENANCE, AND WARRANTY
Free Trial: Where offered, City Scent provides a 48-hour free trial period for eligible products such as diffusion machines. Trial terms, eligibility, and conditions are determined by City Scent and may be changed or withdrawn. Trial products must be returned in good condition if you choose not to continue. Maintenance: Eligible customers may receive complimentary monthly visits as communicated by our team, with schedules varying by branch and product. Warranty: Products are covered against manufacturing defects as described at purchase. Warranty does not cover misuse, unauthorized modification, accidents, or normal wear and tear. Contact us through App support or Section 12 to make a claim.
6. RETURNS AND REFUNDS
If you receive a damaged, defective, or incorrect product, please contact us as soon as possible and within a reasonable time of delivery through App support chat or our contact details. We will arrange a replacement, repair, or refund as appropriate. Refunds, where applicable, are issued using the original payment method or another agreed method. For hygiene and safety reasons, opened or used fragrance products may not be eligible for return unless defective.
7. SUPPORT, CONSULTATIONS, AND USER CONTENT
The App allows you to chat with support, request consultations, send feedback, and upload images such as photos of a product needing service. By submitting messages, images, or feedback, you confirm that you own it or have the right to share it and grant City Scent a non-exclusive right to use it for providing and improving services. You must not submit content that is unlawful, offensive, abusive, misleading, infringing, or harmful. We may remove such content and restrict access to these features.
8. ACCEPTABLE USE
You agree that you will NOT use the App for unlawful or fraudulent purposes; attempt unauthorized access to the App, its servers, or other users’ accounts; interfere with App operations; copy, modify, reverse engineer, or create derivative works; use automated tools such as bots or scrapers; or impersonate any person or misrepresent affiliation with anyone.
9. INTELLECTUAL PROPERTY
The App and all content, including the City Scent name, logo, product names, images, text, designs, and software, are the property of City Scent or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. No other rights are granted.
10. DISCLAIMERS AND LIMITATION OF LIABILITY
The App is provided “as is” and “as available”. While we work to keep it reliable, we do not guarantee that it will always be uninterrupted, error-free, or secure. To the maximum extent permitted by law, City Scent is not liable for indirect, incidental, special, or consequential damages arising from App use, and our total liability for any claim related to an order shall not exceed the amount paid for that order. Nothing excludes or limits liability that cannot be excluded under applicable law, including statutory consumer rights.
11. TERMINATION
You may stop using the App and request deletion of your account at any time. We may suspend or terminate access if you violate these Terms, misuse services, or where required by law. Sections that should survive termination by their nature, including intellectual property, disclaimers, and limitation of liability, will survive.

13. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we do, we will update the “Last Updated” date above and, for significant changes, notify you through the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
14. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Republic of Iraq. Any dispute arising from or relating to these Terms or App use is subject to the jurisdiction of the competent courts of Iraq. We encourage you to contact us first, as most concerns can be resolved quickly and amicably through our support team.
